Terms of Service — What The Spots

These Terms of Service ("Terms") govern the use of What The Spots (the "Service", "Application"). By creating an account or using the Service, the User agrees to these Terms.

1. The Owner

2. Eligibility

The Service is intended for Users aged 16 and over. By creating an account, the User confirms they meet this minimum age requirement. If the Owner becomes aware that a User is under 16, the Owner reserves the right to suspend or delete the relevant account.

3. Accounts

To access certain features of the Service, Users must create an account using an email address or by signing in with Google or Discord.

Users are responsible for:

  • providing accurate information when registering;
  • keeping their login credentials secure;
  • all activity that occurs under their account.

Users may delete their account at any time by contacting the Owner. See the Privacy Policy for details on what happens to associated Data upon deletion.

The Owner reserves the right to suspend or terminate an account that violates these Terms, without prior notice, particularly in cases of abuse, fraud, or submission of content that violates Section 5 below.

4. The Service

What The Spots is a free platform for discovering and sharing spots related to streetwear, sneakers, and city travel culture. The Service is currently provided free of charge. The Owner reserves the right to introduce paid features in the future, in which case these Terms will be updated and Users notified accordingly.

The Owner may modify, suspend, or discontinue the Service, or any part of it, at any time, with or without notice. The Owner does not guarantee that the Service will be available uninterrupted or error-free.

5. User-submitted content

Users may submit content to the Service (such as spots, descriptions, photos, or other material, "User Content").

Review before publication: all User Content is reviewed by the Owner before being published on the Service. The Owner reserves full discretion to approve, reject, edit, or remove any User Content, for any reason, including but not limited to content that:

  • is inaccurate, misleading, or spam;
  • infringes on the intellectual property or other rights of a third party;
  • is unlawful, offensive, defamatory, or inappropriate;
  • violates these Terms or applicable law.

Ownership and license: Users retain ownership of the User Content they submit. By submitting content, the User grants the Owner a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and distribute that content as part of operating the Service (e.g. showing a submitted spot on the website).

User responsibility: Users are solely responsible for the content they submit and confirm they have the necessary rights to submit it (e.g. rights to any photos uploaded). Users must not submit content belonging to third parties without permission.

6. Acceptable use

Users agree not to:

  • use the Service for any unlawful purpose;
  • submit false, misleading, or duplicate content;
  • attempt to gain unauthorized access to the Service, other accounts, or the Owner's systems;
  • interfere with or disrupt the Service (e.g. through scraping, bots, or excessive automated requests) without prior written permission;
  • impersonate another person or entity.

7. Intellectual property

The Service itself — including its design, branding, code, and original content created by the Owner — is the property of What The Spots and protected by applicable intellectual property laws. These Terms do not grant Users any rights to the Owner's intellectual property beyond what is necessary to use the Service as intended.

8. Third-party services

The Service relies on third-party providers, including Google and Discord (for sign-in), Vercel (hosting), Sanity.io (content delivery), and Plausible Analytics (analytics). Use of these integrations is also subject to the respective third party's own terms, where applicable.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. The Owner does not warrant that the Service will be uninterrupted, secure, or error-free, or that content submitted by other Users is accurate or reliable.

10. Limitation of liability

To the maximum extent permitted by applicable law, the Owner shall not be liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, the Service, including reliance on User-submitted content such as spot locations or descriptions.

Nothing in these Terms limits liability that cannot be excluded or limited under applicable Belgian or EU law.

11. Changes to these Terms

The Owner may update these Terms from time to time. Continued use of the Service after changes are published constitutes acceptance of the updated Terms. Users are encouraged to review this page periodically.

12. Governing law and disputes

These Terms are governed by Belgian law. Any disputes arising from these Terms or the use of the Service shall be submitted to the competent courts of Belgium, without prejudice to any mandatory consumer protection rights the User may have under the law of their country of residence if they qualify as a consumer under EU law.
